What Is a QDRO?
A qualified domestic relations order (QDRO) is a legal document that directs the administrator of a retirement plan to award a portion of an employee’s retirement assets to the employee’s former spouse after a divorce is complete. In California, a QDRO can also be used to collect unpaid child support and alimony or to divide property rights.
Without a QDRO, you may not be legally entitled to a portion of your spouse’s retirement benefits. It is important to have a highly experienced and meticulous lawyer draft your QDRO or you may miss out on benefits to which you are entitled.
Why Do I Need a QDRO?
If you and your spouse (or former spouse) have retirement assets, both of you have certain rights to benefits under the other’s retirement plan. A QDRO must be drafted and processed in order for you to receive these benefits.
When Do I Need a QDRO?
If you are getting separated, divorced or are already divorced, you need to set up a QDRO as soon as possible. Many people wait too long and subsequently lose assets due to changes in the market. In many cases, we can promptly prepare and process the QDRO, and you will receive your benefits before your divorce is even final.
